1. Introduction

1.1 This document is published in accordance with Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011. By accessing and using the website, mobile site, or mobile application (collectively referred to as the “Platform”), you agree to comply with these Terms and Conditions.

1.2 The Platform is owned and operated by VIVISARA RETAIL PRIV, a company incorporated under the Companies Act, 1956, with its registered office at Khammam, Telangana, India (“Platform Owner”, “we”, “us”, “our”).

2. Acceptance of Terms

2.1 By accessing or using the Platform, you agree to be bound by these Terms of Use. If you do not agree to these terms, you must refrain from using the Platform.

2.2 These Terms of Use may be amended by the Platform Owner from time to time without prior notice. It is your responsibility to regularly review the Terms of Use to stay informed of any changes.

4.1 You agree to use the Platform solely for lawful purposes and in accordance with these Terms of Use.

4.3 You agree not to engage in any activity that could constitute fraud, abuse, or other unlawful actions in relation to the Platform or Services.

5. Product and Services Information

5.1 We do not guarantee the accuracy, timeliness, performance, completeness, or suitability of the information and materials offered on this website or through the Services for any particular purpose.

5.2 You acknowledge that any errors or inaccuracies may occur and that we are not liable for any damages arising from such inaccuracies.

6. Payments and Charges

6.1 Payments on the Platform are processed using PhonePe as our payment gateway.

6.2 You agree to pay all charges for the Services you avail of, as specified on the Platform at the time of purchase.

6.3 PhonePe processes all payment transactions securely, and by making a payment, you consent to PhonePe’s terms and conditions and privacy policy. You agree to comply with PhonePe’s terms when making payments.

6.4 Payments must be made in accordance with the payment methods available on the Platform, and you authorize the Platform Owner to process such payments through PhonePe.

7. WooCommerce Transactions

7.1 All e-commerce transactions, including purchases of products or services, are processed through WooCommerce, with payments being handled by PhonePe.

7.2 By making a purchase on the Platform, you agree to provide accurate and complete billing information, including name, address, and payment method details.

7.3 You authorize us to charge the specified payment method for the total amount of your order, including applicable taxes, shipping, and handling charges.

7.4 Once your order is confirmed, you will receive an order confirmation email from us, and the payment will be processed via PhonePe.

8. Third-Party Links

8.1 The Platform may contain links to third-party websites. We do not control and are not responsible for the content, policies, or practices of third-party websites.

8.2 Accessing third-party links is done at your own risk, and you should review their terms and conditions before proceeding.

9. Intellectual Property

9.1 All content on the Platform, including but not limited to text, graphics, logos, images, and software, is the property of the Platform Owner and is protected by intellectual property laws.

9.2 You do not acquire any ownership rights in the content of the Platform by using it, and you agree not to infringe upon any intellectual property rights.

10. Limitation of Liability

10.1 The Platform and Services are provided “as is” and without any warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

10.2 We are not responsible for any issues or damages caused by unauthorized access to your account or by your failure to maintain the confidentiality of your account.

11. Indemnification

11.1 You agree to indemnify and hold harmless the Platform Owner, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.

12. Force Majeure

12.1 We shall not be held liable for any failure to perform obligations under these Terms if performance is delayed or prevented by a force majeure event, such as natural disasters, wars, or other unforeseen circumstances.

13. Governing Law and Dispute Resolution

13.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of India.

13.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Khammam, Telangana.
